What exactly is the 2026 Extraordinary Regularization and how does it work?
It is an exceptional and temporary mechanism created so that foreign nationals living in Spain without regular papers can obtain a residence and work permit valid for one year. This process will only be open for a specific period: from mid-April to June 30, 2026. Outside of those dates, it will not be possible to avail of it
What conditions must a person meet to access this regularization?
To qualify for this process, the following criteria must be met:
- Entry before a key date: It must be proven that the person arrived in Spain before January 1, 2026.
- Continuous stay in the country: An uninterrupted residence of at least 5 months is required. This can be demonstrated with documents such as receipts, contracts, medical reports, school enrollment proof, among others.
- No criminal record in country of origin: A criminal record certificate from the country of origin must be submitted, duly apostilled or legalized as applicable.
- No criminal record in Spain: It is also essential to have no criminal record within Spanish territory.
What documents can be used to prove the required residency time?
To justify the 5 months of continuous stay, both public and private documents that prove residence in Spain are accepted. Some valid examples include:
- Lease agreement or municipal registration certificate (empadronamiento).
- Employment contracts (even if not regularized).
- Utility bills (electricity, water, gas).
- Medical certificates or clinical records.
- School enrollment proof for children or for the applicant themselves.
- Tax returns filed.
- Payroll records, even from informal employment.
In short, any documentary evidence that links the applicant to a real and continuous stay in the country for at least five months.
